Terms of Use

Effective October 23, 2026. These Terms replace all prior versions.

1. Agreement between you and Annuity Giants

TheAnnuityGiants.com (the "Site") and the products delivered through it — including Annuity Giants Academy, the AG Simulator, downloadable materials, live and recorded training, and consulting services (together, the "Services") — are operated by Annuity Giants ("Annuity Giants," "we," "us," or "our"), 3890 Charlevoix Ave., Suite 220, Petoskey, MI 49770.

By accessing the Site, creating an account, or purchasing a subscription, course, tool, or service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site or Services. Please keep a copy of these Terms for your records.

2. What the Site is

The Site is an education, training, and software platform built for licensed insurance professionals, financial advisors, and their staff. It provides annuity product education, sales and planning training, illustration and comparison tools, templates, and consulting.

The Site is not a consumer-facing financial, insurance, legal, or tax advisory service, and nothing on it is an offer to sell or a solicitation to buy any annuity, insurance, or security.

3. Professional use and no advice

The Services are intended for use by financial professionals in their own practices. You are solely responsible for:

Verifying product rates, features, carrier information, and illustrations against the issuing carrier's current official materials before relying on them or presenting them to a client.
Complying with all laws, regulations, carrier rules, and firm or broker-dealer policies that apply to you, including suitability, best-interest, licensing, and advertising rules.
Any recommendation you make to a client. Annuity Giants does not know your clients and makes no recommendation about any specific person.

Training content, tools, and outputs (including AG Simulator results) are educational models and hypothetical illustrations. They are not guarantees of performance, not carrier-approved illustrations, and not a substitute for your own professional judgment or official carrier documents. Past results, examples, or case studies do not guarantee future outcomes.

Annuity Giants, its owners, and its instructors may hold insurance licenses and may receive compensation from product sales in their own practices. Nothing on the Site creates a fiduciary, advisory, or agency relationship between Annuity Giants and you or your clients.

4. Accounts

You must be at least 18 years old to create an account or make a purchase. You agree to provide accurate information, keep your login credentials confidential, and accept responsibility for all activity under your account. Accounts are personal and may not be shared, sold, or transferred. One login per licensed user unless your purchase expressly covers a team.

We may suspend or close an account at our discretion, including for credential sharing, chargebacks, or violation of these Terms.

5. Subscriptions, purchases, and billing

Pricing and terms for each subscription, course, tool, or service are shown at checkout and control if they differ from these Terms.
Recurring subscriptions (including Annuity Giants Academy and AG Simulator access) renew automatically at the then-current rate until you cancel. You authorize us and our payment processor to charge your payment method on each renewal date.
Cancellation. You may cancel a recurring subscription at any time through your account settings or by emailing us. Cancellation stops future renewals; it does not refund the current billing period, and access continues through the end of that period.
Refunds. Because our products are digital and delivered immediately, all sales are final unless a specific refund guarantee is stated on the sales page for that product.
Price changes. We may change subscription prices with at least 30 days' notice before the change takes effect on your next renewal.
Taxes. Prices exclude applicable taxes unless stated otherwise.
Payment processing is handled by third-party processors (such as Kajabi and Stripe); we do not store full payment card numbers.

6. Consulting and custom engagements

Consulting, speaking, training, and custom development engagements are governed by the written proposal or agreement for that engagement. Where that agreement is silent, these Terms apply.

7. Intellectual property and license

All content on the Site and in the Services — videos, courses, scripts, slide decks, worksheets, templates, software (including the AG Simulator), data, graphics, logos, and the Annuity Giants and AG Simulator names and marks — is owned by Annuity Giants or its licensors and protected by U.S. and international copyright, trademark, and trade-secret law.

While your account is in good standing, you receive a limited, non-exclusive, non-transferable, revocable license to access the Services for use in your own professional practice. You may use templates, scripts, and illustration outputs with your own clients. You may not:

Copy, record, download (except where a download button is provided), redistribute, resell, sublicense, or publicly post any course content, training, or tool output.
Share your login, or allow anyone who has not purchased access to view the content.
Use the content to build, train, or market a competing training program, course, or software tool.
Remove or alter any copyright, trademark, or attribution notice.
Reverse engineer, scrape, or extract source code, data, or pricing logic from the Site or the AG Simulator.

Carrier names, product names, index names, and third-party marks belong to their owners and are used for identification and educational purposes only.

8. Prohibited use

You agree not to use the Site or Services for any unlawful purpose, or in any way that could damage, disable, overburden, or impair them or interfere with others' use. You may not attempt to gain unauthorized access to any account, system, or data, upload malicious code, or use automated tools to access the Site without our written permission.

9. Community areas and your submissions

The Services may include comment areas, community groups, live Q&A, coaching calls, and other ways to communicate with us and other members ("Community Areas"). In Community Areas you agree not to post anything unlawful, defamatory, harassing, infringing, or misleading; not to share any client's nonpublic personal information; not to solicit other members for recruiting or product sales unless we expressly allow it; and not to post content that violates carrier, firm, or regulatory advertising rules.

We may monitor, edit, or remove posts and may restrict your access to Community Areas at any time. Views expressed by members, guest instructors, or hosts are their own.

You keep ownership of anything you submit (questions, case studies, feedback, testimonials, and other "Submissions"). By submitting, you grant Annuity Giants a worldwide, royalty-free, perpetual license to use, reproduce, edit, publish, and display your Submission — including your name and likeness in connection with a testimonial — for operating and marketing the Services. You represent that you have the right to grant this license and that your Submission contains no client-identifying information you are not authorized to share.

10. Recording

Live trainings, coaching calls, and webinars may be recorded and made available to members. By participating, you consent to being recorded and to our use of the recording as described in Section 9.

11. Third-party services and links

We deliver the Services using third-party platforms such as Kajabi (course hosting and billing), Stripe (payments), Zoom (live sessions), and email and analytics providers. Their terms and privacy policies also apply to your use of their features. The Site may link to carrier websites, industry data providers, and other third-party sites. We do not control and are not responsible for their content, and a link is not an endorsement.

12. Disclaimer of warranties

THE SITE, SERVICES, CONTENT, AND TOOLS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, ANNUITY GIANTS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. Product rates, features, and carrier information change frequently and may contain errors or be out of date. We make no warranty that use of the Services will produce any particular sales, income, or business result.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ANNUITY GIANTS AND ITS OWNERS, EMPLOYEES, CONTRACTORS, INSTRUCTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST COMMISSIONS, LOST DATA, REGULATORY FINES, OR CLIENT CLAIMS, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. Some states do not allow these limitations, so they may not apply to you in full.

14. Indemnification

You agree to defend, indemnify, and hold harmless Annuity Giants and its owners, employees, contractors, and instructors from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your Submissions, your violation of these Terms or any law or regulation, or any recommendation, illustration, or representation you make to a client.

15. Governing law and disputes

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Emmet County, Michigan, for any dispute arising out of or relating to the Site, the Services, or these Terms. Any claim must be brought within one year after it arises.

16. Termination

We may suspend or terminate your access to the Site or Services at any time, with or without notice, for violation of these Terms or any other reason. Sections 7, 9, 12, 13, 14, and 15 survive termination. On termination, your license to the content ends and you must stop using and delete any downloaded materials, except templates and outputs you have already incorporated into work for your own clients.

17. Electronic communications

By using the Site or providing your email address or phone number, you consent to receive communications from us electronically, including by email and, where you have opted in, by text message. Electronic notices satisfy any requirement that a communication be in writing. You can unsubscribe from marketing messages at any time; transactional messages (receipts, renewals, account notices) will continue while you have an account.

18. General

These Terms, together with the Privacy Policy and any product-specific terms shown at checkout, are the entire agreement between you and Annuity Giants regarding the Site and Services. No partnership, joint venture, employment, franchise, or agency relationship is created by these Terms. If any provision is held unenforceable, the remainder stays in effect and the provision is replaced with a valid one that most closely matches its intent. Our failure to enforce a provision is not a waiver.

19. Changes to these Terms

We may update these Terms at any time by posting the revised version on the Site with a new effective date. Material changes affecting an active subscription will be announced by email or in-app notice at least 30 days before they take effect. Continued use after the effective date is acceptance of the revised Terms.

Effective October 23, 2026. This Policy explains what information Annuity Giants collects through TheAnnuityGiants.com and its Services, how we use it, and the choices you have.

1. Information we collect

Information you give us

Account and profile data: name, email, phone, business name, mailing address, licenses or designations, and password.
Purchase data: items bought, billing address, and payment details. Card numbers are collected and stored by our payment processor, not by us.
Content you submit: questions, comments, community posts, case studies, testimonials, support requests, and survey answers.
Tool inputs: information you enter into the AG Simulator or other tools (such as hypothetical client ages, premium amounts, and product parameters). Do not enter a real client's name, Social Security number, or other nonpublic personal information into any tool.
Event and call data: registrations, attendance, and recordings of live sessions you join.

Information collected automatically

Device and usage data: IP address, browser, operating system, pages viewed, videos watched and how far, links clicked, time on site, and referring URL.
Cookies and similar technologies, described in Section 4.

Information from others

Platform and payment partners (such as Kajabi and Stripe) send us purchase, login, and course-progress data.
Marketing and lead sources, including webinar registrations, partner referrals, and industry events where you provide your contact details.

2. How we use information

To create and manage your account and deliver the courses, tools, and services you purchase.
To process payments, renewals, and refunds, and to send receipts and account notices.
To respond to support requests and community posts.
To send training content, product updates, webinar invitations, and promotional offers (you can opt out at any time — Section 5).
To improve the Services, including analyzing which content is used and how tools perform.
To protect the Site, prevent fraud and credential sharing, and enforce our Terms of Use.
To comply with legal obligations and respond to lawful requests.

We do not sell your personal information, and we do not use it to make automated decisions that have legal or similar effects on you.

We share personal information only as follows:

Service providers that help us run the business, under contracts that limit their use of your data: course hosting and billing (Kajabi), payment processing (Stripe), video conferencing (Zoom), email and SMS delivery, scheduling (Calendly), cloud hosting, analytics, and customer support tools. Other members, when you post in Community Areas or appear on a recorded session. Your name and profile are visible to other participants.
Affiliated companies under common ownership with Annuity Giants, including Up North Retirement, for internal operations and, where permitted, marketing.
Business transfers, if Annuity Giants is involved in a merger, acquisition, financing, or sale of assets; your information may be transferred as part of that transaction.
Legal and safety, when required by law, subpoena, or regulator, or to protect the rights, property, or safety of Annuity Giants, our members, or others.
With your consent, for any other purpose you authorize.

4. Cookies and tracking

We and our service providers use cookies, pixels, and similar technologies to keep you logged in, remember preferences, measure course and video engagement, understand site traffic, and show you relevant ads on other platforms (for example, Meta and Google ad pixels). You can control cookies through your browser settings; disabling them may limit some features. We do not currently respond to "Do Not Track" browser signals.

5. Marketing communications

When you create an account, register for a webinar, download a resource, or make a purchase, we may add you to our email list. Every marketing email includes an unsubscribe link. If you opt in to text messages, message and data rates may apply; reply STOP to any message to opt out. Transactional messages about your account continue regardless of marketing preferences.

6. Your choices and rights

Access and update your account information at any time through your account settings.
Opt out of marketing emails via the unsubscribe link, and of text messages by replying STOP.
Request a copy of the personal information we hold about you, correction of inaccurate information, or deletion of your account and data, by contacting us at the address in Section 10. We will respond within 45 days. We may keep information needed to complete transactions, comply with law, resolve disputes, or enforce our agreements.
State privacy rights. Residents of states with comprehensive privacy laws (such as California, Colorado, Connecticut, Virginia, Texas, and others) may have additional rights to access, correct, delete, or port their data and to opt out of targeted advertising. We honor these requests from all users regardless of state. We do not sell personal information and do not discriminate against you for exercising your rights.

7. Security

We use reasonable administrative, technical, and physical safeguards to protect your information, including encrypted connections (HTTPS), access controls, and reputable third-party hosting and payment providers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Protect your password and notify us immediately of any unauthorized use of your account.

8. Data retention

We keep account and purchase records while your account is active and for as long as needed afterward for tax, accounting, legal, and dispute-resolution purposes (generally up to seven years for financial records). Course progress, community posts, and tool inputs are kept while your account is active and deleted or anonymized within a reasonable period after closure, except where retained in session recordings or as required by law.

9. Children

The Site and Services are for financial professionals and are not directed to anyone under 18. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact us and we will delete it.

10. Changes to this Policy and how to contact us
